BCSO Statement on ICE

Buncombe County -- Press Release Buncombe County Sheriff's Office: As the Sheriff, I am not in charge of operating the churches or schools

within this community but I am elected to ensure the safety and security

 of ALL the residents in Buncombe County.  WE are a community of WE and because I have deputies positioned in schools as School Resource Officers, my stance is clear and strong that immigration enforcement is not allowed on our school campuses unless forced through a valid
court order. 

I have repeatedly spoken out against cooperation with ICE, saying federal immigration law is not the responsibility of local officers and damages law enforcement’s trust within the immigrant community.  I also indicated in the past that I would not comply with just an ICE “detainer”  to hold undocumented immigrants taken into custody, however, the passing of HB10 amended that compliance to involve the issuance of both a detainer and an administrative warrant in order to hold someone undocumented in custody for up to 48 hours.  As much as I have constitutional concerns about holding someone who is able and willing to post bond and subsequently be released, I do not make the laws, I only enforce the laws. 

The Buncombe County Sheriff's Office (BCSO) will not be partnering with ICE to help enforce federal immigration laws beyond following HB10 which is only after someone has committed a crime. BCSO deputies will not be arresting and detaining persons to solely investigate
immigration status in the absence of probable cause of an independent crime, that is racially profiling and unconstitutional.

funcionamiento de las iglesias y escuelas parte de nuestra comunidad, pero fui elegido para
garantizar la seguridad y protección de TODOS los residentes del condado de Buncombe.
NOSOTROS somos la comunidad de NOSOTROS (Community of WE), y debido a que tengo
oficiales asignados a las escuelas como Oficiales de Recursos Escolares (SRO, por sus siglas en
inglés), mi postura es clara y firme: no se permite la aplicación de la ley de inmigración en
nuestros campus escolares a menos que se lleve a cabo mediante una orden judicial válida.
Me he pronunciado repetidamente en contra de la cooperación con el ICE, afirmando que la ley
federal de inmigración no es responsabilidad de los oficiales locales y que perjudica la confianza
de la comunidad inmigrante con las fuerzas del orden. También he indicado en el pasado que no
cumpliría con sólo una “orden de retención” de ICE para mantener a los inmigrantes
indocumentados bajo custodia, sin embargo, la aprobación de la HB10 modificó ese
cumplimiento para implicar la emisión de una orden de retención y una orden administrativa con
el fin de mantener a alguien indocumentado bajo custodia durante un máximo de 48 horas. Por
mucho que tenga preocupaciones en cuanto al retener a alguien que puede y está dispuesto a
pagar la fianza y posteriormente ser puesto en libertad, yo no hago las leyes, sólo las hago
cumplir.
La Oficina del Sheriff del Condado de Buncombe (BCSO, por sus siglas en inglés) no se
asociará con ICE para ayudar a hacer cumplir las leyes federales de inmigración más allá de
seguir la ley HB10, que se aplica únicamente después de que alguien ha cometido un delito. A
menos que haya causa probable de un crimen, los oficiales de BCSO no arrestarán ni detendrán a
personas con el único propósito de investigar el estatus migratorio, ya que eso es considerado perfil racial e inconstitucional.
