NC Doctor Charged With Distributing A Controlled Substance
WNC -- A North Carolina physician appeared before U.S. Magistrate Judge Susan C. Rodriguez September 29, 2023.
The allegations against the doctor were unlawful distribution of a prohibited substance, according to U.S. States Attorney's Office Western District of North Carolina press release.
After his initial court appearance, Henry Ronald Emery, Jr., M.D., 52, of Waxhaw, N.C., was indicted with one count of conspiracy to distribute controlled substances outside professional medical practice and 11 counts of distribution.
U.S. Attorney King is joined by Robert J. Murphy, Special Agent in Charge of the Atlanta Field Division of the Drug Enforcement Administration (DEA), which oversees the Charlotte District Office, and Donald "Trey" Eakins, IRS-CI, Charlotte Field Office.
The indictment alleges that Dr. Emery, a North Carolina-licensed physician, conspired with others to intentionally and unlawfully prescribe, dispense, and distribute a mixture and substance containing a detectable amount of buprenorphine from September 2018 to 2022. Dr. Emery was indicted on many counts of illegally distributing buprenorphine outside of professional practice and for no medicinal purpose.
Dr. Emery faces 10 years in jail and a $500,000 fine on each indictment count if convicted.
Charges against Dr. Emery are allegations. A defendant is deemed innocent until proven guilty beyond reasonable doubt.
U.S. Attorney King congratulated the DEA and IRS-CI for their investigation in today's announcement.
The case is being prosecuted by Charlotte Assistant U.S. Attorneys Nick J. Miller and William Bozin.
