The incident took place around 11:04 a.m. on Sunday, November 16th, on I-40 West near Exit 44. APD Patrol officers responded to the scene following reports of a collision involving a pedestrian.
The preliminary investigation indicates that 44-year-old Daniel Gardner (DOB 07/16/1981) was fatally injured when he walked into the main travel lanes of the interstate and was struck by a tractor-trailer. Mr. Gardner was transported to Mission Hospital, where he later succumbed to his injuries. Police confirmed that his next of kin has been notified.
The driver of the tractor-trailer remained at the scene and cooperated fully with law enforcement throughout the investigation. Officers temporarily closed the travel lanes on I-40 West to allow the collision investigation unit to process the scene.
Upon the completion of the Asheville Police Department’s investigation and after consultation with the Buncombe County District Attorney’s Office, officials determined no charges will be filed against the driver of the tractor-trailer involved in the fatal incident.
