Asheville -- May 7, 2026: A South Asheville collision that resulted in the death of a local woman has led to charges against another Asheville resident, prompting questions about the legal path forward beyond an initial traffic citation. Jane Neill Hughes, 68, of Asheville, faces a charge of misdemeanor death by motor vehicle following the incident on Sweeten Creek Road.
The collision occurred on April 20, 2026, at approximately 2:53 p.m. on the 3300 block of Sweeten Creek Road. According to an Asheville Police Department news release, "Officers initially responded to a motor vehicle collision with injuries... a 20220 Cadillac Escalade operated by Hughes pulled out of a parking lot while attempting to turn left to travel northbound." This movement led to a collision with a 2003 Toyota Echo driven by Kathy King Dalton, 68, also of Asheville, who was traveling southbound.
Dalton sustained severe injuries in the crash and was transported to Mission Hospital, where she succumbed to her injuries nine days later, on April 29, 2026. Her next of kin has been notified. Initially, Hughes received an on-scene citation for unsafe movement. Following Dalton's death and further investigation, the Asheville Police Department consulted with the Buncombe County District Attorney's Office, leading to the additional charge of misdemeanor death by motor vehicle.
Hughes subsequently turned herself in to the Buncombe County Detention Facility and was booked under a $5,000 unsecured bond. North Carolina law defines misdemeanor death by vehicle as causing death through culpable negligence or violation of motor vehicle laws without intent or malice.
